DEBT AND BANKRUPTCY : Setting Aside Statutory Demands
We are routinely instructed by clients to set aside Statutory Demands. An application to set aside a Statutory Demand is to be made within 18 days of the Statutory Demand being presented. The Judge considers the application and then decides as to whether a hearing is necessary to hear the dispute. If a genuine triable issue exists, the Statutory Demand is usually set aside by the Court. |
